Midjourney is asking a federal court to overturn a magistrate judge's order that blocked it from accessing Warner Bros. Discovery, Disney, and Universal Studios' AI training practices and business plans. The studios sued Midjourney for copyright infringement over generated images of characters like Superman and Batman. Midjourney argues the studios themselves train AI on copyrighted works and wants to use that evidence to support its fair use defense. A magistrate judge in June limited disclosure to only "consumer-facing" AI applications; Midjourney contends the withheld evidence is central to proving the studios engage in the same practices they're suing over.
